1. Purpose

The purpose of this policy is to outline how the Registered Training Organisation (RTO) collects, uses, stores and discloses personal information in accordance with the Privacy Act 1988 (Cth) and other relevant legislation.

The RTO is committed to protecting the privacy of learners and ensuring personal information is managed responsibly and securely.

2. Scope

This policy applies to all personal information collected by the RTO from:

▪ Students and prospective students
▪ Employers or sponsoring organisations
▪ Staff and contractors
▪ Other individuals interacting with the RTO

3. Collection of Personal Information

The RTO collects personal information from students for the purpose of processing and managing enrolment in vocational education and training (VET) courses.

The types of information

collected may include:
▪ Personal identification details
▪ Contact details
▪ Training and assessment records
▪ Demographic information required for government reporting
▪ Personal information may be collected through enrolment forms, online systems, email
communication, or other administrative processes.

4. Use of Personal Information

Personal information is used to enable the RTO to:

▪ Deliver vocational education and training courses
▪ Manage student enrolment and training records
▪ Assess competency and record training outcomes
▪ Issue certification documentation
▪ Meet regulatory and reporting obligations as a Registered Training Organisation.

5. Disclosure of Personal Information

Under the National Vocational Education and Training Regulator Act 2011 (NVETR Act), the RTOis required to disclose personal information collected about students to the National VET Data Collection managed by the National Centre for Vocational Education Research Ltd (NCVER).

The NCVER is responsible for collecting, managing, analysing and communicating research and statistics about the Australian VET sector.

The RTO may also disclose personal information to the relevant state or territory training Authority where required by law.

6. How NCVER and Other Bodies Handle Personal Information

The NCVER will collect, hold, use, and disclose personal information in accordance with applicable legislation, including the Privacy Act 1988 (Cth) and the NVETR Act.

Personal information may be used and disclosed by NCVER for purposes including:
▪ Populating authenticated VET transcripts
▪ Administration of VET
▪ Facilitation of statistics and research relating to education, including surveys and data linkage
▪ Understanding the VET market and workforce planning

The NCVER is authorised to disclose information to:
▪ The Australian Government Department of Education, Skills and Employment (DESE)
▪ Commonwealth authorities
▪ State and Territory authorities (other than registered training organisations)
▪ VET regulators and other authorised bodies

These disclosures may support:
▪ Program administration and regulation of VET KITA Privacy Policy 3
▪ Monitoring and evaluation of training programs
▪ Statistical research and policy development
▪ Consumer information about the VET sector

NCVER may also disclose personal information to individuals or organisations engaged by
NCVER to conduct research on its behalf. NCVER does not intend to disclose personal information to overseas recipients.

7. Department of Education, Skills and Employment

The Department of Education, Skills and Employment (DESE) is authorised by law to collect, use and disclose personal information to fulfil functions relating to vocational education and training.

8. Surveys

Students may receive a participant survey administered by:
▪ a government department
▪ NCVER
▪ an authorised agent or contractor
▪ another authorised agency

Participation in surveys is voluntary, and individuals may choose to opt out at the time of contact

9. Access and Correction of Personal Information

Individuals have the right to request access to personal information held by the RTO and Request corrections if the information is inaccurate or incomplete.

Privacy Complaints

Individuals may make a complaint if they believe their personal information has been handled inappropriately.

Complaints will be handled in accordance with the RTO’s complaints handling procedures
